The Nigerian Electricity Regulatory Commission (NERC) has announced the transfer of regulatory oversight to the Ogun State Electricity Regulatory Commission (OGERC).

The transfer was announced in a public notice by the NERC via its X handle on Monday


NERC said the transfer is in line with This aligns with the amended Constitution of the Federal Republic of Nigeria (CFRN) and the Electricity Act 2023.


The notice said:

“Nigerian Electricity Regulatory Commission (“NERC” or the “Commission”) has issued an order to transfer regulatory oversight of the electricity market in Ogun State from the Commission to the Ogun State Electricity Regulatory Commission (OGERC).”


The Nigerian Electricity Regulatory Commission (NERC) has reaffirmed its role as the central regulator under the Electricity Act 2023 (EA 2023), maintaining oversight over inter-state and international generation, transmission, supply, trading, and system operations.


The EA 2023 mandates that any state seeking to establish and regulate intrastate electricity markets must formally notify NERC and request the transfer of regulatory authority to its state regulator.


NERC stated that the Ogun State Government has “complied with the conditions precedent in the laws,” formally notified NERC, and requested the transfer of regulatory oversight for the intrastate electricity market to the Ogun State Electricity Regulatory Commission (OGERC).

NERC’s transfer order includes the following provisions

Subsidiary Incorporation:


Eko Electricity Distribution Company (EKEDP), Ikeja Electric PLC (IE), and Ibadan Electricity Distribution Company (IBEDC) are directed to incorporate subsidiaries—EKEDP SubCo, IE SubCo, and IBEDC SubCo, respectively. These subsidiaries will assume responsibility for the intrastate supply and distribution of electricity in Ogun State.

Timeline:


“EKEDP, IE, and IBEDC shall complete the incorporation of their respective subsidiaries within 60 days from 24th December 2024,” NERC stated.

Licensing Requirements:


The subsidiaries are required to apply for and obtain licenses for intrastate electricity supply and distribution from OGERC.

NERC emphasized that “all transfers envisaged by this order shall be completed by 23rd June 2025.”
